Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Earbuds Labs ("we", "us") governing your use of our mobile applications, widgets, and website at earbudslabs.com (the "Service"). By downloading, installing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

Earbuds Labs is an independent developer. The Service is not affiliated with, endorsed by, sponsored by, or connected to Samsung Electronics Co., Ltd. or Xiaomi Corporation. "Galaxy Buds", "Samsung", "Xiaomi", "Redmi" and related marks are trademarks of their respective owners and are used solely to describe compatibility.

You must be at least 13 years old (or 16 in the EEA/UK) to use the Service. By using it you represent that you meet this requirement and can form a binding contract in your jurisdiction.

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

Some features require a paid subscription ("Pro"). Subscriptions are billed by Apple App Store or Google Play at the price shown at purchase and renew automatically at the end of each billing period until cancelled. Cancel any time from your platform account settings; cancellations take effect at the end of the current period.

Refunds are handled by Apple and Google under their store policies. We can help you request one but cannot issue store refunds directly.

Free trials, if offered, convert to paid subscriptions unless cancelled at least 24 hours before the trial ends.

You agree not to: (a) reverse-engineer, decompile, or attempt to derive source code except as permitted by law; (b) use the Service to infringe intellectual property or violate any law; (c) probe, scan, or test vulnerabilities without written permission; (d) resell, sublicense, or provide the Service as a hosted product; (e) use automated means to abuse the Service or its APIs.

The Service, including all software, design, branding, and content we provide, is owned by Earbuds Labs and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

You retain rights to any content you upload (e.g. EQ presets you save). By uploading content you grant us a worldwide, royalty-free license to host and process it as needed to operate the Service.

The Service integrates with third-party providers including Google Firebase, AppStack, and RevenueCat. Your use of those integrated services may be subject to additional terms. We are not responsible for third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH EVERY DEVICE OR FIRMWARE VERSION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARBUDS LABS AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

You agree to indemnify and hold harmless Earbuds Labs from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of the Service.

We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination will survive.

We may update these Terms. Material changes will be announced at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

These Terms are governed by the laws of your country of residence to the extent required by applicable consumer-protection rules, and otherwise by the laws applicable to Earbuds Labs's place of establishment, without regard to conflict-of-laws principles.
